Martyn Prowel Solicitors will take you through the transaction from beginning, including negotiating and advising on the heads of terms of the agreement, through to completion and post-completion matters. All legal title issues, including any restrictions on the client’s use of the property, as well as boundary issues and any other matter which could affect the client and the property. The total costs are transparent at an early stage.
Funding the transaction
If you are obtaining a mortgage or are borrowing money from a bank or other lender to finance your transaction, we can advise on the security the lender requires, including different types of legal charges (mortgages), personal guarantees, cross guarantees and other types of security. We are often able to act for both you and your lender, depending on the lender’s requirements and the particular circumstances of the transaction. If the lender is independently advised, we will liaise with their solicitors to satisfy the lender’s requirements in order to release funds to complete.
Stamp Duty Land Tax
The rules which apply to Stamp Duty Land Tax (SDLT) are complex. We will advise on your obligations relating to SDLT including the amount payable where you are a purchaser or a tenant, whether any exemptions exist to exempt you from paying all or part of the SDLT, or if you are entitled to defer payment until a later date.
Energy Performance Certificates
We can put you in touch with commercial energy performance certificate providers. Since October 2008, energy performance certificates must now be provided by sellers and landlords when selling, letting and constructing all commercial properties regardless of size, with certain exceptions; please contact us for further advice.
Property disputes
We can also advise where there is a dispute or potential dispute regarding a property, for example where there is a breach of obligations by one of the parties, including non-payment of rent.
Auctions
Sales of properties at auction are becoming increasingly popular. We can prepare an auction pack for you in readiness for marketing your property. We can attend the auction with you, whether as a seller so that we can deal with queries raised by potential buyers, or if you are a buyer, we can attend to raise relevant enquiries of the seller before you commit to purchase. If you are a buyer intending to purchase at auction, we recommend that you always instruct a solicitor to review the legal paperwork before you bid, as otherwise you may be tying yourself in to purchase a problematic property and escaping the sale contract without financial penalty may be very difficult, if not impossible.
